The issues of implementation, operation and administration of legislation underpinning carbon sink forests was referred to The Senate Standing Committee on Rural and Regional Affairs and Transport for inquiry on 26 June 2008. The Committee is yet to publish its findings, however Senator Heffernan has raised a number of concerns including the structure of current carbon sink legislation, issues with the delivery of legislation, the lack of register for titles and the need for universal Governmental legislative carbon property rights. Further, the Senator believes that Carbon Sink Forest legislation should be implemented as part of an ETS not retrospectively after the scheme has been established. If legislation is not thoroughly explored prior to its implementation, rogues within the market will capitalise on legislation shortfalls and as such these issues should be addressed now.
